Work Rights During Studies
In general, full-time international students with a valid F-1 visa are permitted to work up to 20 hours per week on campus when classes are in session and when classes are not in session it goes up to 40 hours per week. For international students who wish to work while studying in the US, there are stringent regulations. Off-campus employment is not permitted for students with valid F-1 visas unless they meet the eligibility conditions and acquire official authorisation. Regulations governing immigration severely restrict a foreign student's ability to accept employment away from college. Students who are caught working illegally risk losing their F-1 student status for failing to maintain their status.
Bringing your dependents
A dependent of an international student may go to the United States at any time. Spouses and/or unmarried minor children are considered dependents. Children older than 21 are not permitted to enter as the dependents of an F-1 or J-1 international student. Dependents of international students may apply for their F-2 or J2 visas concurrently with the application for an F-1 or J-1 visa by the international student, or they may do so at a later time. If they are given the visa, they might come to the country at the same time as the overseas student or at a later time.
Work rights for your spouse
The F-2 dependant (spouse) visa holder is not permitted to work. An employer must be willing and able to sponsor an F-2 dependent for an employment visa if they want to work in the United States, whether it be paid or unpaid.
After entering the US in J-2 status, holders of J-2 dependent (spouse) visas are qualified to apply to USCIS for a work permit.
Post-Study Work Rights / Stay Back Option
Students who have finished their course and choose to remain in the United States are eligible for the Post-Completion OPT (Optional Practical Training) permit. An OPT post-completion allows you to remain in the country for at least 12 months.
Students may work full- or part-time (at least 20 hours per week) when the permission has been approved. After graduating, you have 90 days to find employment. Your chosen career path must be connected to your field of study in order to qualify for a Post-Study Work Permit.
What if you Wish to Stay Longer?
Students who have requested a post-completion option may work for a maximum of one year. In order to qualify for an additional extension of 24 months, the student should have completed their STEM studies should have secured employment in a relevant profession.
