Australian Visa rules eased by states for Skilled Migrants

Australia is facing severe issues related to the shortage of skilled migrants, and the states and territories will be easing certain terms for visa applications. Typically, all migrants are required to be sponsored by employers for a visa to stay in the country.

At times of need, however, the state and territory authorities can step in to nominate skilled workers for visas, and recently they have been relaxing the terms and conditions that are required to obtain state-sponsored visas. This makes it easier for skilled migrants to obtain Australian visas.

State-sponsored Australian visas: what are they?

Skilled individuals can be nominated by state and territory authorities under the State Nominated Migration Program.

• Those holding a state-sponsored visa need not be tied to a particular employer. However, there is an age criterion and the individual must be below the age of 45.
• Note that there is no job guarantee, so they have to find their own position.
• Applicants who are successful are given a permanent visa allowing them to live in the country indefinitely (Skilled Nominated subclass 190 visa). Alternately, they are provided with a pathway to become a permanent resident after working in regional areas as part of the Skilled Work Regional (Provisional) (subclass 491) visa. 
• A few visas are also available for business owners.
• This year, there are almost 50,000 state-nominated visas available!
• New South Wales has been allocated the highest amount of State-sponsored Australian visas.

Why do states require more spots? 

Especially after the pandemic, there is a high demand for skilled workers in some states. Western Australia has doubled its number of visas after their government lobbied the federal government for an extra allocation, and this financial year they are offering 8,140 places.

As WA Premier Mark McGowan noted, the changes would help boost skilled migration in areas of high demand. He further said, as quoted, ”WA’s strong economic growth, very low unemployment rate and high demand for skilled workers mean there is a need to attract in-demand workers through a variety of channels to help sustain our economy.”

Occupation lists have been loosened for almost every industry in WA, and the same is true for other states. Overseas professionals who have the right type of qualifications are invited to apply for state nomination.

What are the revised visa opportunities in each state?

• Western Australia:

This statenow has the third largest allocation of state-nominated spots in the country. There are a whopping 5,350 subclass 190 visas and 2790 regional visas available, and over 100 extra jobs were added to its skilled occupation list this year.

• Victoria:

Victoria has the second highest number of state-nominated visas available. There are as many as 11,570 places for 2022/23. This state is offering the highest number of subclass 190 visas (9,000), as well as 2,400 regional visas and 170 business visas.

• Queensland:

The list of eligible occupations in the Queensland list has been expanded to include 114 occupations in 2022/23. In this financial year, 3,000 subclass 190 visas, as well as 1,200 regional visas and 235 business visas are up for grabs.

• South Australia:

SA’s sponsorship program applications are already open. There are more than 500 occupations eligible, and this region has been allocated 2,700 subclass 190 visas, 3,180 regional, and 70 business visas.

• Northern Territory:

This is one of the few jurisdictions that will not be accepting overseas applications. Additionally, successful applicants must agree to live and work in the NT for at least three years.

• New South Wales:

With the largest allocation of state-nominated positions, New South Wales offers over 12,000 places.
